Can someone explain how maternity leave works?

Ok, here’s the situation. I was taken out of work a couple months early due to pregnancy issues. I currently get temporary disability from the state. Once the baby is born in a couple weeks, what happens then? My employer doesn’t have “maternity leave”. They just give you whatever ny state allows (which is fmla) and I believe I get 6 weeks off if the birth is natural. Does this fall under temporary disability also? Will I continue to receive a disability check or would it be a totally different thing? I plan to ask human resources about this asap but the lady I have always talked to was recently fired and they’re replacing her. Nobody seems to have much information for me currently. So if anyone has any idea how this whole thing works, I’d appreciate it.

It varies in every state, but in California, you would continue to receive temporary disability to the limit of their coverage, and if your employer paid you any money, it would be deducted from the disability.

You can contact the agency that sends you the disability checks and ask them about the terms and conditions.

@YARNLADY Thank you. I was wondering if that was the case. That sounds about right. I will contact the agency and ask them about it to make sure. I just wasn’t sure if the check would be coming from the same place or not.

I went out early, too, and got disability for that period. However, if I remember correctly, in my state the company didn’t have to pay me anything, nor did I receive disability after the birth of my child, as I was no longer disabled. (That was under FMLA, too.)
