Is Bankruptcy an option in my case.

I have a hospital bill of $8000.00. I only draw Social Security. How much could the collection agency demand to be deducted from my check if it comes down to that scenario? Or would this qualify me for bankruptcy

From what I understand, SS checks cannot be touched unless you owe the government. So you may be in the clear.

It will fuck your credit but they can’t touch your Social Security.

The first two are correct, they can’t touch your social security. Contact the collection agency and offer a small monthly payment. It doesn’t have to be much, because anything they get is a plus for them. Even 20 or 30 bucks a month is enough. Don’t bother with bankruptcy, because the lawyer’s fees are ridiculous.

Roby, when you say you are on Social Security, what do you mean? Are you drawing payments for SS disability, retirement or survivors benefits? I just wonder what type of medical plan you have. There may be ways to negotiate with the hospital.

Social Securty Retirement. I offered them $50.00 a month and they said I had to pay half of it before they would go that route. Looks like something will be better than nothin. They did say tat they would take it to court and garnishee my check.

I do want to thank you all for your responses. I was unaware of Sec. 207. [42 U.S.C. 407.
I do want to say that I don’t mean to ignore the bill. I do mean to pay on it as much as I can a month.

Here’s another tip: Collectors lie. They can’t garnish your SS check.
