What can I do about this DMV problem?

Asked by Riser (3485points) May 19th, 2008

Ok… I never got a notice in the mail, but apparently my license has been suspended and I have a warrant out for my arrest. Apparently I have to go to the Lake Tahoe court to get the warrant removed AND would you advise I get my car put in my partner’s name so I can insure it?

This is all hit me at me once when I tried to pay my insurance bill… ugh. I love the government.

The big question is “Why was your drivers license suspended?” Did you forget to renew or do you have unpaid tickets? You shouldn’t drive without a license so transferring ownership of your car to your partner would open a can of worms legally, because you just gave your car away. Plus an arrest for driving without a license would dig the hole deeper. Is the Tahoe Court on the Cali or Nevada side? Are you a resident of Cali or Nevada? Laws differ on each side.

I forgot to add:

Another thing that baffled me is I received no notices from the DMV or the court. I was told if I sent in a proof of insurance (did not have it in my car when I was pulled over) that I wouldn’t have to travel 500 miles to court. Well, I did that and… alas… it turns out I did have to be in court.

I trust my partner. I am not worried about losing my car, but at least it can be insured, because, right now, it is illegal, in Los Angeles, to have an insured car anywhere, but in a garage. It is parked by our complex.

gailcalled? Witness Protection? OK, what did Riser do?

Neva or Cali side of Tahoe? So you were driving without insurance?

California side of Tahoe and when I was pulled over I didn’t have proof of insurance on me, although I was insured. I have to go to the court to prove I had insurance at the time the ticket was issued. The police officer told me I could send it in to avoid having to travel 500 miles to court. I was irresponsible in taking his word for it and when I tried to pay my monthly insurance bill, my company called me, telling me there is a warrant out for my arrest, my license is suspended and they can not insure me.

I never received anything in the mail from the court or the DMV.

Contact the court and/or a bail bondsman ASAP. You need to get a court date set to get the warrant removed. Otherwise, you run the risk of going to jail if you (or the car you are riding in) are pulled over for any other reason.

I agree with kevbo. I think if you contact the court and tell the judge everything you just told us, there is a chance you can get this straightened out. But hopefully you won’t get one of those cranky judges that tells you ignorance of the law is no excuse. I think you should try this before putting anything into Michael’s name. That will make it look like you are trying to dodge the law and could come back to bite you in the butt. Good luck with this Dan. I hope you get it worked out.

1. Follow what kevbo said.
2. Plan another vacation in Tahoe,
drinking & gambling at CalNeva is
always a good idea. I’ve known
some people to hit a few jackpots
on the slots spending a few hours
drinking & gambling there.
3. Plan on public transportation, car
pools, taxi, or have your partner
drive to work & play.

Do not drive the car to Tahoe! Use a plane or bus or something.

Consider legal representation they may be able to resolve this with out your traveling to Tahoe. The cost may be less than the trip and the strees reduction may be worth it as well.
