how do you get discovery on evidence or hearsay in a motion pleading that the plaintiff has entered into the motion?

? I’m going to take a stab here and say that there should be a signed affidavit with attached supporting material and it is meant to be supplied by the plaintiff’s side. Is this a full-on court case? If it is arbitration or small claims, I believe copies of the information is handed out at the time of the hearing and you have no right to it beforehand, I don’t think.

Do you have a lawyer or does the plaintiff have one? All this stuff is meant to be exchanged between the two sides before the court date, I thought.

The clerk should have what you are looking for. If its to be admitted into evidence in open court, both sides have the legal right to view any evidence that is to presented.
