Can a person be sued for discrimination while dating?

The way this is world is going, I don’t see any reason why not. They won’t want to leave any stone unturned.

Well, the corollary to you question is diversity in who you date. For example, could there be a law that before you marry, you need to date two Asians, three blacks, several Jews, and a bunch of different Christian denominations before you actually get married.

Or would there be a law that says that every heterosexual must have at least one homosexual relationship before marrying (and if gay, one heterosexual relationship).

Just for the sake of conversation…

There’s a radio talk show host who’s been around a long time, by the name of Tom Leykis. His target audience is males 18–35.

Part of his schtick, is convincing single adult males that they shouldn’t date single mothers.

If enough single mothers were rejected for dates due to the influence of Leykis, could they collectively have a civil rights case?

One can sue anyone for anything. But one must have standing in order to sue, and one must show damages fro a resolution. How would you resolve the case? One person has to go out with the other? Would the plaintiff enjoy spending time with a hostile defendant? And would it be dutch treat? After all, the plaintiff could have asked the defendant out.

And one must show discrimination based on something besides the personality or looks of the plaintiff. And the plaintiff must demonstrate that the defendant actively discriminated against a class, not just against one person.

Are you asking if a person could be sued by his or her date? Or are you asking if a third party can sue one of the two for dating the other? What exactly ARE you asking? You do this a lot.

Well isn’t that the eternal thing about dating? I like blondes, but she’s brunette. He’s too short, or she has freckles. The answer should be that you can’t sue someone for not being attracted to you, regardless of the reason.

We ALL discriminate when choosing whom to date. That’s how things get narrowed down to who is the best fit. That’s hardly a conceivable basis for a lawsuit.

So how on earth could someone formulate a lawsuit? Based upon what? And more importantly, how would they ever know that they’ve been discriminated against ?

For example, lets just say that a guy is a dwarf and would prefer to date only other dwarfs. Could an average size person sue him for discriminating against her?

Suppose in his younger years he did have one date with an average size lady and thats why he realized that he wanted to only date dwarfs.

So how would any future average size ladies be able to PROVE discrimination since he did have one experience dating average size? Since she isnt a mind reader, how would she know that was his last? You see the problem here don’t you?

Just substitute the words for any category of concern (race, religion, height, sexual orientation) and it comes out the same.

A court cannot determine someones intent to discriminate because they aren’t mind readers. And the person bringing the suit has no credible proof that the persons intent is discriminatory.

Pretty ridiculous scenario all around.
