What is the punishment if you get pulled over in Los Angeles and police officers find a marijuana pipe in your trunk?

Asked by punkrockworld (960points) July 25th, 2009

Just want to know what cops would give you if they find a piece in the trunk of your car that has some resedue pot in it.

Jailtime! At least that’s what it used to be. I think

Police officers don’t sentence or punish. They arrest. What follows is an appearance in court, where a judge will decide.

Possession of drug paraphernalia is not the same thing as possession of drugs. Pipes are sold openly.

Give him the marijuana lol call it even.

depends on how much. We’re sending all our prison guards home of furlow right now. I don’t think they want to crowd the prisons with minor drug infractions right now. Heck, Oakland just started taxing medical Marijuana

If it was just the pipe, I wouldn’t be too worried about it.

they will do a drug test and if it comes out positive you’re screwed.

Depends on how big a dick the cop is. I’ve seen cops in L.A. drive by people smoking pot, let people go who could easily be busted for possession, and laugh when finding a huge bong in a car.

How far do you want to press your luck?

I have no idea about the drug laws in CA, but in IL, possesssion of paraphenalia is a WORSE offense than possession of the drug itself, who the hell knows why.

@Judi I literally just read that now. How awesome is that?

Hopefully the city becomes dependent on the tax revenue, and states take notice. I can only hope.

Had they already had their do-nuts or were they headed for them? If the former, you are toast. If the latter, depends on when they had their last glaze fix. If they are shaking, they are hurting and will probably let you go….unless, of course, there is a drive-thru Krispy Kreme in the area, in which case you are in for a brief detour on your way to the slammer.

Seriously, it depends on why they pulled you over in the first place, whether you appear blitzed, and how you behave during your little visit with them.

Why on Earth would you let them look in your trunk?

dynamicduo's avatar

Of course, you would never consent to letting them check your trunk, because you wouldn’t give them any reason to ask, right?

If they found drug paraphernalia in your trunk, it may or may not be probable cause for a search of the rest of your car and the people in the car, and if any of you guys have weed on you, then the trouble really happens. If they found the pipe and didn’t want to search you or you car, they would probably confiscate it and run tests, then charge you with some charge, you’ll have to look up your laws in Los Angeles to find out what charge exactly.

Then again the cop could also not give a hoot and let you go on your business. But that’s not a risk I’m willing to take really.

Im with Zendo. Never give them consent to search, especially if you’re doing nothing wrong. Once you give them consent to search the cabin, you give them consent to search the entire vehicle.

If this has happened to you, IANAL. If you just want to know, ask the cop on the corner. Better yet, don’t keep shit in your car.
