Who is responsible for my road?

I live in a small town that is in Broward county Florida. I have lived in home for nine years. The Town of Southwest Ranches has fixed the potholes on my road since I lived here. Recently, the town says that I’m responsible for my roads. They say that I own half of my side of the road and that my neighbor owns the other half. The town also says that I’m responsible for anyone that gets hurt on my road. If what they say is true would I be responsible 100% or would the town own half since they made the last repairs??

Call the town attorney. Then call your attorney.

Do they have some kind of contract or easement that shows you are liable or are they just pulling this out of thin air? Your best bet is to contact a lawyer.

I agree with @gailcalled. You need to discuss this with an attorney. I was looking at the Southwest Ranches website and it says that most of the roads there are public but there are also many private roads. I think it would really be worth the money and time to consult an attorney on this and find out exactly what the status of your road and what your liability could be, and if you are liable and responsible for what happens on the road what steps you can take to protect yourself.

I’m not sure. I am a grand smart alec though. If I were you I would share this serious liability with the neighbor and close your section of the road off to public. Whenever everyone from mail carriers to school busses start complaining you can toot about how you wouldn’t want anyone to get hurt and it is closed until you save enough for the costly repairs. It might not work for long but it would certainly get your predicament A LOT of public attention!

Look at your deed, that should tell you. I agree with @gailcalled you need to check with an attorney.

Technically you and your neighbor will be responsible for road maintainance, but…yes, consult an attorney about the arbitrariness of the situation.

I have lived on many private roads where fees were collected for upkeep, grading, gravel etc.

But..I have never heard of a county foisting private roads off on residents when they have held a public status.
