If I buy a new 3 g iPhone, and give my nephew my old one, can he use it like an iPod touch?

or would there be new activation required. With the new pricing, the market for older 4gig units will be small.

With a non-jailbreak’d phone, no. It will just sit at the “Activation Required” screen forever. However, if you jailbreak it, I believe you can bypass activation and use the Wifi and other functions normally. The only things that won’t work would be the phone itself and anything that depends on Edge network access.
