What level on the IQ scale denotes not being smart enough to consent to sex?

You have less than popular teen girl of 16 with an IQ of 82, it is discovered more popular buy 17.5 years old and co-captain of the basketball team has been coming over before her mother gets home and under the guise of liking her and having her as a ”secret B/F” been boinking her. In the real he has another girl who is his ”public” G/F (yes, he is two-timing both of them and they do not know it). Seeing he doesn’t like his “secret G/F” but she loves him so she thinks, is it rape? Is it just boorish behavior on the part of the teen jock? Does she have to have an IQ below 80 before it is considered rape, or even if she did because she feels she loves him it wouldn’t be? If she was 19 but was the ”secret G/F” or booty call of a 28 year old man would their be a crime if she felt she loved him or not?

82 is considered “dull’ but not borderline deficient. That would be someone below 80. There is a general scale guideline here
So the sex is consensual, but yes, he is a boor. He could in certain states be guilty of statutory rape.

You don’t state what his IQ is. 35% of the population has an IQ between 85 and 100. Philosophically, if their IQs are close enough, would you consider it taking advantage?

18 years old… or else Stephen Hawking would be charged with raping anyone with an IQ less then 165… besides that eugenics is a crime now… IQ is bull it’s just a test…one shouldn’t force ones will upon another from a single score on a test

IQ isn’t a measure of the ability to make judgements (though I bet there’s a correlation).

On the other hand, I’ve never heard of anyone with an IQ of 180+ getting laid.

@talljasperman one shouldn’t force ones will upon another from a single score on a test I do not think a single test score would set someone up as being an easy mark. If that is who that person is, just on the low end of the IQ scale which lends somewhat of their ability to reason and make pertinent and/or prudent judgment. There are many instances where someone who is considered less than averagely intelligent are prevented in entering contracts and legal agreements, etc. I have not seen anyone being seen as slow or an idiot because they score poorly or did bad one one IQ test.

Wait a second….IQ and intelligence is NOT related. There are some really stupid pervs out there.
It is the age of maturity and not how many elements of the periodic table you can name, that is the issue here.

MOST humans will have sexual urges after 12 or so. And so many are not responsible for their actions…..not matter how smart they may be.

Taking advantage of the underage or mentally slow has ALWAY been a bad thing to do.
