Bank of America website down, can't pay bills, how can I document that I tried to log on to pay bills so I can argue missed payments or late payment?

Asked by kelly (1918points) March 1st, 2011

I’m concerned about being late on my mortgage payment and the effect on credit rating and a “history” of a late payment. I think I should be able to document that I tried to get on BoA site so to defend creditors dinging my credit history. How can i do that?

Do they have a number you can call and speak with someone? I’m not sure about BoA since I don’t bank with them, but some banks have people available after normal hours as well. I’d definitely keep trying and call as soon as I could if I wasn’t able to get online. In the future, I wouldn’t wait until the last minute (if you did) just in case something like this happens again.

What Seaofclouds said. They do have 24-hour phone service. 1 800 442 6680. Phone and tell them and get them to make a note on your account. Hopefully then you can have your charges reversed later.

There should be an 800 number that you can call. Then change your habits and pay earlier from now on. There might be a way to set up an automatic pay system too, after you get this problem worked out. You also should document the time and date that you attempted to go online and the system was down (make sure you put the time zone you are in too). And if you speak with someone who can’t help you, make sure you get their name (usually a fake code name or number, but it’s still acceptable and document the time you spoke to that person).

I would imagine that somewhere in the agreements that you have with BoA is a clause that lets them off the hook for failure of the website, connectivity issues in general or your inability to connect. It is up to you to make the payments on time. Their website (they would say, and rightly, I think) is “for convenience only”. Your payments still have to be on time.

If you can, sign up for automatic payment deductions from your checking account. It’s far more reliable and you don’t have to remember a thing, since the payments are deducted on the exact day of the month that you specify. I’ve been paying my mortgage that way now (though not on BoA) for about four years or more, and I wouldn’t do it any other way.

Its true there are problems http://technolog.msnbc.msn.com/_news/2011/03/01/6163594-bank-of-america-online-banking-down-for-now
Call them, They surely have telephone banking facilities?

its online for me. I check my bofa account several times a day and they are rarely down except after midnight for nightly runs.
If you are concerend about the Mortgage, go on their website and transact it there. It is the one bill I make sure I do on the mortgage companies site.

Looking @Odysseus’ link, it seems like the problem with their site being down is pretty well documented so you shouldn’t have a problem. If the site is back up and you make your payment follow up with them to make sure that if your payment was late due to their website failure that it does not show as late on your record.

Your contract to pay your mortgage by a certain time every month did not have a clause in there stating “IF the website is working properly”. Call, mail, wire money, etc. if you have to. You are responsible for it, and the website isn’t your only option, it’s just your most preferred option. Tracking your online attempts to pay will not help you fight any creditors whatsoever if they decide to flex their legal right to report to your credit bureaus.

Make an old-fashioned payment. Go to the bank and hand them your money.

Internet down is really not an excuse.

Even if you could log in tonight, it wouldn’t be processed until regular business hours anyway, and I doubt the site will be down for more than a few hours…..I’m sure everything will be just fine.

If you yourself make mistakes or have issues, that’s your problem. If a company makes mistakes or has issues, that is also your problem.

Not trying to be a troll… just seems to be how the world works :p

@peridot In this case it’s not that the company can’t accept any payments and is making it the customers problem. It has several payment methods and just one of them is down at the moment. It’s 100% the customer’s responsibility to get the payment there on time regardless of their website being down or not.
