Do I have a right to complain in this situation to HOA?

Asked by AshlynM (10684points) August 8th, 2011

They recently installed speed bumps in our condo complex but they’re too high. Lower cars can’t pass over them without them scraping the bottom of the car, and it’s not a small scraping sound. It’s loud and I’m guessing that’s not good for the car.

These speed bumps are the kind you see in parking lots. Except they’re higher. In my opinion they don’t need to be that high. It’s fine for a truck or jeep to pass through, but my mustang can’t pass it properly.

I could go around them but some jerk deliberately keeps parking directly in front of the bump, where you can’t go around.

Yes, buut you shouldn’t view it as complaining I don’t think. You live in the condo complex. You have every right to bring things than concern you to the attention of the HOA. That’s what they’re there for. Whether or not they can or will do anything about it is another story but you have absolutely every right to bring your concerns to them, in my opinion, particularly if it is a problem that you believe risks damage to your personal property or is an issue of safety.

I would definitely let them know. The last thing they want is to be responsible for fixing people’s cars.

My husband’s Mustang got stuck on a speed bump once. Hahahaha. It was in Mexico 30 years ago. The bump was so big and high, all four tires wound up off the ground.

You should say something. Start with that you have a concerns the bumps as they are might be a liability to the HOA, and that you suggest modifying them. That way you don’t sound like you just want to get rid of the bumps. Maybe ask if there was a specific size decided on before they were put in? If so, and the company made them higher or larger than contracted, it will be their expense to fix them.

Where I live now every street must be layed down by men who drive trucks, because I can barely get out of intersections, or turn onto main roads, because where roads meet the slant is so severe I cannot drive straight over the area without scraping the bottom of my car. Drives me crazy. This is the only city I have ever had this problem. It’s unsafe.

Ram the speed bump and catch air so your car goes over it! just kidding

You have every right to bring this concern to the table. That is how things get done.

Definetely complain. Write down the time and date you did complain and who you talked to. This is for future reference, if an automobile is damaged, because of the “too-high” speed bumps.

The Metro Gov. here was resurfacing a road. The sewer metal covers were left too high for a car to pass over, without physical damage to the undercarriage of vehicles. There were no warning signs or cones placed over the covers to warn motorists. My neigbor attempted to run over one of the sewer covers and totaled out his station wagon. The city and the private contractors had to replace his vehicle.

This is why you take notes.

Might be a good idea to include a photo of your car on the bump, or of the underside of your car…
