How do "Breastaurants" get away with the discrepancy in dress codes for their female employees vs. the males?

Of course I haven’t done an exhaustive amount of personal investigation by going to a ton of these places. I’m going off my viewing of episodes of Undercover Boss.

The women’s outfits are the usual sexually titillating short shorts and skimpy tops with breasts pushed up alluringly.

The men were usually wearing regular slacks and a top bearing the logo of the establishment; no revealing short shorts or anything of the sort. (I do understand that managers, in general, usually dress differently from the rest of the staff. But not every male employee shown was a manager.)

How come they aren’t being sued right and left for the discriminatory dress codes toward women?

The women choose to work there knowing what type of establishment it is. The men do so too. Why not ask about strip clubs? Same concept.

Just shooting from the hip here but perhaps it has to do with male/female attitudes.

Women are, in my opinion, more accepting of skimpy dress on members of their own sex than men are. In other words, while not her first choice, a woman might go to Hooters if that is where her date/S.O. wants to go and not be put out whereas a man would be more reluctant to go to a restaurant called Peckers that had skimpily clad male waiters flaunting their junk and it is all about getting customers through the door.

Because men in short shorts and skimpy tops with breasts pushed up alluringly are not generally regarded as a sexually titillating sight to the “Breastaurant” market.

Well, obviously, I agree with your observation.

But what I’m curious about is why, in our litigious society, nobody has sued their asses off yet?

I might add that women (from my male perspective) don’t really seem to desire a Prickstaurant. Women (again, from my male perspective) don’t desire to see a man’s junk so much as his broad jawline.. or broad pocketbook. The junk part is sidelined to so many other contributing factors. Women don’t need or even want a Prickstaurant. In this way, men are more imbecilic (as a whole and in general).

Breastaurant’s feed on the stereotypical, animalistic nature of men.. not women.

That’s not to say that women don’t have that same animalistic desire.. they just go about it in a more sophisticated manner than “ooooo boobies”. Breastaurants are counting on the “ooo boobies” factor.

Now I’ve gotten so sidetracked that I forgot what my point was. Perhaps because I’m thinkin about boobies now.

I suspect this may be covered under dress codes for different jobs/tasks? Chefs may have to wear a certain outfit, while servers may have to wear another. I haven’t been to any of these places, but I would imagine the role of a “server” in one of these places is not just to serve food – it’s to be eye candy for the customers, right? Women working in a male strip club would probably not be required to skimpy outfits. Just a guess.

In that case, the courts universally have had a tough time ruling for the letter of the law in Title VII.

It may be to prevent the absurdity of facing a suit by a man who wanted to wear short shorts, skimpy top and pushed up breasts, instead of traditional male attire in certain jobs.

It’s a good bet that the employers are on firm ground considering the nature of the business and the requirements of a “uniform” for employees. And it’s well accepted that the uniforms can differ between men and women.

Well, if a male pushed it, I suppose he could get a court ruling that the club had to hire him, and had to allow him to wear the same clothes as the women. However, I don’t see that going over very well. I can imagine patrons asking for any waitress except him. So…..

As many of you have pointed out, there isn’t a huge demand for “Priskstaurants” etc. and that makes sense. But that wasn’t really my question.

I’m still wondering why no enterprising woman hasn’t brought suit claiming sexual harrassment in terms of what they’re required to wear. The fact that they know about I ahead of time doesn’t necessarily make it any more equitable.

I’m just really surprised nobody has taken a shot at suing them. I find it kind of surprising in our current sue-happy society, don’t you?

@Buttonstc – Well, it appears that existence of these male positions may be a result of a previous lawsuit.

“But the chain also agreed to create a few other support jobs, like bartenders and hosts, that must be filled without regard to sex.”

And there is also this case.

Very interesting. I’m a bit surprised that neither of those cases received much exposure all things considered.

But at least they’re not getting away with it totally.

I just couldn’t imagine that all those girls working at these places were so thrilled to be dressed like that. There had to be some somewhere with an ounce of common sense left in their brains :)

@Buttonstc The fewer clothes a woman has on the bigger the tips from men. Lots of women have no problem taking advantage of men who don’t have an ounce of common sense left in their brains, once they see boobs.

I’m sure that’s true for a lot of them. But for those who don’t buy into that, it might be nice if there were at least a semblance of choice. And there were at least a few as attested to by the info in the second link. There are still some who prefer to be able to use their brains as well as their breasts :)

There is nothing to “buy in to.” It’s not a rumor, it’s a fact. It’s the men who are “buying into” something, and something really brainless IMO.

As far as being able to use their brains as well, we are talking about waitressing @Buttonstc, not computer science. Actually, many college students work in that field, and in strip clubs, etc., to make money enough to put themselves through school so that when they graduate they can go on to careers that actually call for brains.

There are lots of different restaurants out there. Most don’t require the servers to be half naked. If someone doesn’t like it, go work somewhere else….and don’t bitch about not making nearly the amount in tips at the new place.

Locally, we only have “Tilted Kilt” and it would seem to me that a lawsuit from a male server would have a greater chance there, with a kilt being traditional male attire.

The last time I drove by our “Kilt” there was a large table of middle aged women eating out on the patio. Maybe the food is good?
