What is up with Kim Davis, the county clerk who won't do same sex marriages?

Asked by jca (36062points) September 13th, 2015

Today on a news show, they said Kim Davis, the county clerk who won’t do same sex marriages, and was just released from jail for failure to do so, is planning to file an appeal. Appeal will be for those who work for her to not have to do same sex marriages either.

What the Fluther?

I don’t have a link as I am ready to walk out the door and don’t have time to research or link. However, the place I heard it was the CBS Sunday Morning Show.

Maybe a closet homosexual masqueraiding as a right wing nut? Four marriages, yeah I want to follow this nut job.

Sounds like an attention whore.

JLeslie's avatar

Whack job. I’m thinking she likes the attention and feels sure she is doing God’s work, and has no understanding of equal rights and freedom of religion.

Jaxk's avatar

As I understand it, she has 5 deputy clerks that are willing to sign off on gay marriage licenses. She should have been impeached when she originally refused to do her job but now she won’t allow anyone to do her job. Put her back in jail until she either agrees to do the job or resigns. I have no sympathy, when the solution is so simple.

She was released a week ago.

She doesn’t realize her circus has packed up and left town. It’s over.

When the rules of the game change you have the choice to play by the new rules or get the hell off the playing field.

The issue in question is that the license forms carry her printed name, or perhaps have an official stamp, with her name on it as County Clerk. She objects to such forms being issued for a same sex marriage. That is her appeal. Her efforts to stop any licenses until her appeal is heard was denied.

The judge in the case has said that she cannot interfere, and let her out of jail if she did not interfere with her clerks issuing licenses. If she does, back to jail she goes.

Buttonstc's avatar

She wants to have her cake and eat it too. Filing a lawsuit keeps the publicity train rolling without her having to go to jail again for defying the judge’s order.

What’s happening now with the other clerks issuing the certificates is the compromise deal which the judge tried to offer her before sentencing her.

She refused saying that she couldn’t guarantee not interfering with the other clerks.

So, that landed her in jail with the publicity she was seeking. She now knows that if she does interfere, she will get bounced right back to jail as the judge warned.

I’m guessing she found out that jail was not that comfortable. So, filing a lawsuit is her way of protesting without outright defying the court and getting herself bounced back to jail.

But lawsuits take a long time to wend their way through the system so her fifteen minutes of fame are just about over.

There’s not much news value in continuing to report that the suit is still in progress. Hopefully, news outlets and everyone else forgets about her for the next few years.

I’ll certainly be glad to stop hearing her name in the news every damn day :)

Years? You mean days, or even hours before they forget about her @Buttonstc.

She sounds like a religiously over zealous holier-than-thou freak.

janbb's avatar

She is trying to be a martyr for the cause of “religious freedom“and she has plenty of backing from some of the Republican candidates. She is not a lone wolf nutjob – although she is a nutjob.

Dutchess_III's avatar

Oh, she will be a lone wolf nutjob pretty soon. Cruz and his ilk will drop her as soon as they’ve milked her for every bit of publicity they can.

Jaxk's avatar

If you democrats don’t like her, throw her out of the party. She is a Democrat and you all elected her not the Republicans. Take a little responsibility for your own actions.

Darth_Algar's avatar

Do people even pay attention to what party one belongs to when running for little offices like county clerk? This case aside it’s about one of the most non-political public offices one can hold, and in many cases people running for such offices run unopposed. And in little shitbilly counties like this one it’s less about what party you’re registered with and more about how well your neighbors know/like you.

(Besides, if she’s such a staunch Democrat then why are Republicans like Ted Cruz and Mike Fuckabee fawning over her?)

JLeslie's avatar

There’s the possibility no one ran against her. I don’t know if that’s the case, but in a small town it’s very possible.

I like that she’s a Democrat. Lol. I didn’t even know that all
this time. There are still socially conservative white Democrats sprinkled through the South. I always find it surprising.

I heard that since her name as the elected official is on the document, it violates her religion, and they are being issued “in her name” without her blessing.

Dutchess_III's avatar

Pretty sure her deputies are signing. I don’t think they’re pre stamped or anything.

Judi's avatar

Dutchess, her name is on the top of the form.

Dutchess_III's avatar

Ah, well. She needs to figure out what to do, then.

@Jaxk “If you democrats don’t like her, throw her out of the party. She is a Democrat and you all elected her not the Republicans. Take a little responsibility for your own actions.”

Looking at where she lives, I can see how she may be considered liberal enough to be forced to run as a Democrat. I mean, she didn’t shoot any of the same-sex couples, and that seems like a rather progressive attitude for the region. I can also see it being possible that only one candidate from each party was nominated and grabbing the Democrat nomination being easier than the Republican one. I mean, fewer opponents increases the odds, especially for those that don’t have the skill and/or charisma to make their own odds.

Southern Democrats are a whole separate breed that tossed themselves out of the Democratic party a few decades back when other Democrats were “trying to destroy the Southern way of life” though totalitarian things like racial integration. In fact, the South is a totally different type of place from the United States of America, so trying to draw parallels between our country and the South is a bit tricky.

Regardless, unlike hardcore Conservatives who slap the RINO label on anyone they feel is too liberal (Colin Powell, Ronald Reagan, John McCain, anyone who believes Obama was born in Hawaii….) the Democrats aren’t as concerned with having an utterly homogenous group marching in lockstep, and many of us unaffiliated voters have a “Not my circus, not my monkeys!” attitude

On a related note, when will the Republicans denounce Trump, Cruz, Palin, Huckabee, and the rest? They are quite quick to disrespect a POTUS who won two free-and-fair elections and the Pope, so I think it safe to assume that while Democrats ignore their loons, the Republicans exalt their’s.

“Put her back in jail until she either agrees to do the job or resigns.”

Yep. I prefer my public servants to comply with statutes and laws. Then again, I think that violating a state statute alone is just cause for impeachment anyways, so the choice may be made for her… if the legislature decides to do a little work instead of stay on vacation until next year.

In a non political election without party designation, she ran as the child of the. Previous clerk, who had passed away. Offices like this in rural places like Kentucky are virtually a family business.

She is most likely a democrat because Nixon’s Southern Strategy has not yet reached their backwater county.

jerv's avatar

It would seem that the Oath Keepers’ planned security detail has been waved off. Kim Davis’ legal team had concerns that it would escalate into another Bundy Ranch incident and they would prefer to avoid the risk of violence.

jca's avatar

It was just on the news (Monday). She said any marriage license her deputies issue is not valid and won’t have her name or authority on it. County (Kentucky County, not my county) Attorney said the licenses will be valid. And it continues…...

Dutchess_III's avatar

Actually, I found this very interesting. the Republican party was ”Founded by anti-slavery activists, modernizers, ex-Whigs, and ex-Free Soilers in 185…” So the rolls were reversed. The dems fought for the “right” to keep other human beings as property, while the republicans were fighting for freedom for all humans.
This may explain why she calls herself a Democrat, although I just have a feeling she didn’t vote for Obama.

At any rate, political parties have absolutely nothing to do with this situation.

Dutchess_III's avatar

@jca boy, that girl has just gotten too big for her britches, hasn’t she.

Darth_Algar's avatar

Also political parties aren’t necessarily one big hive mind. There may be people who are socially conservative, but who vote Democrat because they align more with the Democrats’ economic policies. Just as there are people who are socially liberal, but agree with the Republicans’ economic platform. It all has to do with what one prioritizes as a voter.

It could be that Kim Davis prefers the Democrats’ economic policy or something. Or it could just be that she’s a southern Dixiecrat who hasn’t gotten the memo yet. At any rate her party affiliation is of no relevance here. This is not a Democrat/Republican thing.

I just saw something cute about this on Seth Myers tonight.

He does this segment called “Extreme Dog Shaming” where people post cute handwritten “confessions” from their dogs admitting to various misdeeds.

So underneath the pic of a cute little cocker spaniel there was this “As a Kentucky County Clerk, not only do I refuse to sign same sex marriage certificates, I also pee on them. ”

It got a chuckle out of me :)
