When should or shouldn't police need a warrant to enter your home, regarding COVID?

That is, if you’re having a gathering at your home, and you’re reported to have more than the allowable number of guests.

Probable cause is all they need to break up a party. Warrant is for evidence a like drugs and guns to be admitted for a trial.

@Tropical_Willie They would need a warrant to actually go in the home and search. Or, they could get permission to search the home (which can be revoked at anytime, so they’d just go for the warrant).

Breaking up a party doesn’t mean they have to enter the home. They can’t just enter a home like that anyways without permission.

If you are having a gathering illegally, they will knock on the door and tell you that you need to break it up. They can’t just enter the home unless you say they can (or warrant), and they wouldn’t even be able to get a warrant unless there was some other reason like drugs or something. A party isn’t enough unless they have something else too

Warrant requires a judges signature, I know but 50 cars outside a house during COVID-19 is . . . . . . .

Everybody coming out will have a ID check and names will be written down, in my state.

@Tropical_Willie yeah, 50 cars outside of a home is probable cause I guess (considering the COVID and local laws I suppose). Some of my answer was for you some was for @flo

They should always need a warrant to enter a private residence. The Executive Orders limiting gatherings generally don’t extend to personal, private residences. Now, the cops could come to your door and ask what you have going on. But unless you invite them in, they cannot actually come in to count the number of people. All they can do is remind you of the hazards of large gatherings and the EO concerning them. But you could just as easily thank them and send them on their way. By the time they could get a warrant to come in to break up the party, it would likely be over anyway.
I’d say the cops have bigger fish to fry, but this sort of thing is high on the Democrat’s list of ways to disrupt our society, so they might try making it a big deal.

@seawulf575 back to the “Democrat hoax” reason that it’s okay killing people with the spread of COVID-19 ! SMH
License plate numbers will be recorded, I know from my youth at large parties.

@Tropical_Willie Is that deflection? It looked amazingly like deflection to me! But let’s review what you are comparing. A virus, which spreads as it should, by natural methods. Compared to riots and looting and killing which is all Dem/Leftist driven. Virus is not being spread to disrupt society, rioting and looting and killing are. SMH

Our state has had repeated campaign parties / meetings for the GOP candidate for Governor; with 50 to 100 people not a masks to be found, were you at one of attendees? ?
