Should Trump not be held accountable for instigating a violent riot?

Asked by SQUEEKY2 (23114points) January 7th, 2021

Anyone else would be arrested, but not Trump?
Shouldn’t he be removed from office, or at least resign?
There was a death, people injured, and a great deal of vandalism.

Yes, he should. Immediately. We don’t wait for proof of guilt before arrest, only before conviction. Probable cause is all over the place.

And this wasn’t just a mob and an instance of domestic terrorism. It was an attack on the seat of the U.S. Government while it was in session.

Just imagine if an event like that had been fomented by a foreign power. We would be at war right now. No one should even think of overlooking this act of insurrection just because the president incited it. All the more reason to take the necessary steps to curtail his power and end this reign of terror.

I think that legally there is very little that can be done, since he is not directly causally linked to the riots. He did not lead the mob himself, and he did not tell them to storm the capitol.
And I am very doubtful that his inciteful and borderline seditious behaviour beforehand is a solid enough argument to charge and convict him for this riot.
Sure, I would love him to get charged with, and convicted of, four counts of Felony Murder.

Please, @ragingloli, could we borrow Angela Merkel for a couple of weeks?

@Jeruba
She is not going to run again for chancellor, so she will be permanently available starting in October.

Yes, I read that. You’ve enjoyed a rational, principled leader for a long while, so could you share?

At this point, though, I would even like to rent Prince Charles.

He should be out of office before the end of the day Friday.

Every decent American in Congress should be doing everything possible towards impeachment, 25th amendment action, and resignation.

The House is ready to impeach. Cabinet officers and Pence should be pressured to invoke the 25th. And Republicans should be telling Trump he should resign to avoid being thrown out.

And another question?^ If that happens and it should would that kibosh his chances for 2024?
Or would he still be able to legally try and go for it in 2024?

He should be barred from ever holding any sort of public office ever again, effective immediately. If it were up to me, we’d start there. But we wouldn’t stop there.

It would be nice if the same could be leveled preemptively at his offspring, but that, I’m afraid, would not be legal. More than one U.S. official has won election while serving a sentence.

He should, but I am not sure where I am in terms of wanting him removed ASAP or just biding time until Biden. I saw a statement by Scaramucci in Newsweek online: “Worried about the next 13 days,” Scaramucci added in a later tweet. “Trump will always go lower; it has to do with his self loathing and the pleasure he takes in causing pain in others. Do not underestimate him. Think the worst but remember you are not capable of thinking like him due to his malevolence.”

I don’t believe Trump could ever win in 2024. Too many Republicans now leaving his train, he could never get the upper Midwest, Arizona, I don’t see how he could ever win now.

Trump is solely responsible for these people believing the election was a fraud. If he had conceded we wouldn’t have widespread belief in stupid conspiracy crap.

He has to be removed. They will riot again on the 20th if he gets away with this.

Yes. But it’s like kicking a dog for peeing on a fire hydrant. I would be reluctant to serve on a jury trying Trump. I can’t imagine anyone more fit for a finding of mental incompetence. What argument does the most adept of prosecutors come back with when Trump’s lawyer says : “Your honor, ladies and gentlemen of the jury, my client is crazy as a bedbug”?

Call_Me_Jay's avatar

No jury has to try him. Only the VP and cabinet (25th amendment) or Senate (conviction after impeachment) can remove him.

Senate conviction does not require evidence and fact-finding like a criminal trial. It is a political decision and only requires ⅔ approval from the Senate. They don’t have to prove anything, they only have to be willing.

^^^ will it happen??

SQUEEKY2's avatar

After yesterday @Dutchess_III we can only hope.
I hate to think the damage The Don Father can do in the last 13 days of his reign of terror.

@SQUEEKY2 Trump could pardon all the insurgants. Hopefully there are we have no hurricanes to nuke right now. He could pull out of the UN. He can invade North Korea for 60 days without Congress approval.
