What kind of justice is achieved if someone is tried and judged in the court of public opinion?

Asked by mazingerz88 (28796points) March 14th, 2021

And what if the person “sentenced as guilty” by the public didn’t do what he or she was accused of, is it even possible for this person to get justice for the pain and suffering he or she had to endure?

That can only be known to the accused. It would be a matter of or to what extent the accused gives a shit about public opinion.

Depends on the specifics.

Nothing resembling justice will be achieved. Public opinion is too fickle, it surges first one way and then the other according to nothing more solid than a newspaper headline or a Facebook post.

The court of public opinion can be a serious problem, because often the public doesn’t have all of the facts and people seem to like to have someone to blame.

More recently witnesses are able to video events, and especially when the video is over an extended period, it leaves little that needs to be questioned. In fact the public might have more facts if the video is deemed inadmissible in court.

Can the person get justice for pain and suffering when falsely accused? They possibly can sue the person who falsely accused them, but some damage cannot be undone.

Mob justice, generally speaking.

IMHO, that’s what happened to Hillary Clinton in 2016. Public opinion in that case was guided by the echo chamber of right-wing media. Benghazi, pizzagate and other “incidents” were recounted by right wing media, many times using other similar media outlets as sources.

I voted for her in 2016. I know some didn’t vote for her because they didn’t want a criminal in the White House.

How ironic!
