Can public schools legally ban colored hair?

Asked by joshisradd (238points) February 18th, 2008 from iPhone

High schools in this area will not allow “non-traditional” hair colors. The schools do not have uniforms. Can they legally do this? Or is it a bluff on their part?

Public (government) schools or private schools? (I’d tend to think that private schools would have more leeway than public schools to make such stipulations. One basis for an argument might be that it could disrupt learning and socializing. I’m not a lawyer though.)

No way josé! A public school can’t hold down your right to the first amendment!!!

However, I believe they can legally stop any activity that disrupts learning, and that can be liberally applied. It would be very easy to make the argument that brightly colored hair causes a distraction and therefore it disrupts learning. Even if you tried to fight it, I’m pretty confident that you would lose.

In the place where I live the public schools require uniforms and regulate hair color and styles.

I agree with Perchik, in a public high school while you legally still have the right to free speech, if your freedom of speech is deemed to be an interference or disruption of learning, then the school system as an entity, has the right to prevent your use of free speech. However if you feel that such power is being improperly administered you can legally appeal the school’s prevention of free speech. In private schools, it is a completely different matter, it is really dependent on each school, so the best thing to do if you are in a private school, is to talk to the head of the school.

Trust me on the public school thing, I work for the student newspaper and we have had many issues with freedom of speech and the school’s ability to prevent a student’s use as such.(At least in Massachusetts)

I died my hair purple plenty of times but never got in trouble. But one of my friends died their hair blue and got suspended. I personally don’t think that colored hair is a problem.
