If you were charged with a misdeamonor domestic violence can you still become a teacher?

Asked by BanginBaxter (631points) December 30th, 2009

Ten years ago I was charged with a misdemeanor 5 domestic violence. I shoved my husband at the time(he is now my ex), and he had me arrested for domestic violence. I am now going to school to become a teacher and one of my classes require me to get a criminal back round check so I can observe in a school classroom. My domestic violence will show up…so now I am wondering what I should do?? Can I even become a teacher with a charge like that? I have put so much work into this degree and now this!

I am confused that you didn’t check this out before you declared your major. I suggest you talk to the teacher ASAP and come clean. Explain exactly what you have told us here. It might be fine since it was a misdemeanor. You may even be able to have it expunged if you contact an attorney. It WAS 10 years ago.

What state do you live in?

Such a small thing. Don’t see how that would matter. IDK what the hiring policies are
however. might wanna check with someone.

Here’s a good article on what it means to expunge it and I am sure it varies by state.

I live in Ohio…and I was planning on getting it expunge. The problem is that this is just a class to get into my bachelors program, but since I will be observing in a school you have to get 1. a back round check and 2 a TB test. I knew it would be an issue later but I didn’t think it would be an issue now. I was not aware that I was going to have to have 35 hours of classroom observation for this class. And I spoke with a lawyer today and he said there are some things that you cannot get expunge.

Could definitely be a problem. I work in the summers as an aide at a special education school in Ohio and there is a long list of misdeamonors/felonies that prohibit you from working there. Most schools will probably be wary of having someone with that background.

If this class is checking what makes you think a school won’t do the same when you try to get a job? You really need to call and ask someone locally that can answer this better than we can.

I don’t think getting charged with something carries the same weight as being convicted. If you were only charged, and not convicted, it might not even be on your record.

The regulations vary in each state, so be sure to find out what your state requires. Also get a police report on yourself so you can see what is there.

@YARNLADY is right. Were you convicted?

I dont think i want you as a kids teacher, what if you just wanna shove them?

I have been recently arrested for domestic violence, I was drinking and blacked out- I can’t remember anything, the next thing I know I was being arrested? I received my acceptance letter for schooling to finish my degree and now I don’t know if I will be able to get financial aid. If I will be able to get my degree to teach.
I even went to a doctor who diagnosed me as clinically depressed and a psychologist who said the same thing.
What am I to do?

Yes, I declared my major a long time ago, didn’t think things such as an argument can get myself into trouble. Let alone getting arrested and having to contact an attorney, which I have done by the way. Great article on expunge – hopefully, it doesn’t get that far.
Thanks
