If you are arrested for drunk driving but not convicted, do you still need SR-22?

My brother was arrested for OWI almost a year ago but he wasn’t convicted because of some technicality. I asked him today when he would get his license back, and he said that he was going to wait until his insurance would not put him on SR22. I suspect his psycho wife is trying to keep him from getting his license back and told him some crap so he wouldn’t get it.

He should call the DMV and find out if it’s on his record. He can even probably run a drivers record check on himself. Usually arrests can’t count against things because we have this “innocent until proven guilty” thing here in the USA
