Can the State Of Arizona make a Law that requires Presidential candidates to present a birth certificate before running for office?

Asked by BoBo1946 (15325points) April 22nd, 2010

If you did not see the interview last night on Anderson Cooper 360 discussing the Arizona Birther Bill with Arizona’s congressman Cecil Ash, you should watch this video before answering the question.

This is unbelievable!

Arizona passed the bill, but don’t think the bill is Constitutional and will removed by the Supreme Court eventually.

What are your thoughts on this bill?

To be honest, I couldn’t care less. I think it’s an idiotic bill, but then again, I’m not a U.S. citizen.

I watched the video and was amazed at certain points brought to my attention, concerning Obama.

To answer your question, Arizona and all the other states can enact laws to do whatever and their laws with actually have no meaning. why? because Federal Law is promiment over state or local laws, in most cases.

Ever heard of frivilous lawsuts?

@bob_ Hey Bob, even if you are not a US citizen, the video is worth watching.

If I lived in Arizona I would raise a stink about my state government wasting money on making a law that will do nothing.

Did the bill get past the Governor? I hadn’t heard that he approved it yet. I think it’s entirely absurd in every way, and I think it will be a complete waste of taxpayer dollars for the state of Arizona when they have to defend it in court. Actually, it’s already been a waste of taxpayer dollars while the congress in Arizona debated it. Even if it is found to be constitutional (which is questionable at best), it’s such a useless law that the cost of defending it is a waste win or lose.

@Snarp cannot answer that….

it was really funny to watch Anderson Cooper shoot holes in this guy…bet he does not sit down for a week…he got an old fashion asskicking!

@john65pennington and @BoBo1946 What points were brought to your attention about Obama by that video? I did not see anything about Obama in there?

BoBo1946's avatar

@marinelife ummm..Ash was asked if he thought Obama was a citizen and he said yes….but, also he told Anderson’s producer a different story. Lot of contradictions in Ash’s comments!

marinelife's avatar

@BoBo1946 Right. But what does that say about Obama? It tells you that Ash is an idiot—and a dissembler.

BoBo1946's avatar

@marinelife Ash avoided comments of being critical of Obama on the air (back stage different)!

Love the part about where Anderson asked Ash, “where was George Bush born and Bill Clinton!”

As we know, this is more partisanship politics! Same old stuff!

“powers not granted to the national government nor prohibited to the states by the Constitution of the United States are reserved to the states or the people.”

So, does this mean, the Law in Arizona could become Law…would it not take a Constitutional Convention with ¾ of state radifying this Law to stand as Law of the Land???

Judi's avatar

Obama DOES have a birth certificate, but like me, whit his mother moving often the original has been lost. I doubt the law would have effected his candidacy.

Snarp's avatar

@Judi The problem is, who sets the standard of proof? What state’s procedure is used, and if you’re state has a different birth certificate standard from Arizona, will you be prevented from being on the ballot there? The birthers simply are not satisfied with a level of proof that ought to be more than sufficient, and if they expect this law to require something more than Obama has already produced, then there’s a big problem.

gorillapaws's avatar

This is just more proof that Republicans have no problem at all with wasteful government spending when it’s for conservative causes…

phillis's avatar

What does this mean – who sets the standard? There is no state standard. They’re federal mandates found in the U.S. Constitution. Every president must adhere to the same standards since those standards were enacted in 1777. I don’t know about anybody else, but I can get copies of my birth certificate all day long for $10 a pop. I never had a problem showing mine.

@BoBo1946 I’ll watch the video in a few. Thanks for the link!

Snarp's avatar

@phillis The constitution says nothing about birth certificates and very little about citizenship in general. The term “natural born citizen” used as a requirement for the Presidency is essentially undefined. There’s no question that Obama has a valid Hawaiian birth certificate no different from the one any Hawaiian would get if they requested theirs today. Some people have different ones from that time because they have an older copy, Obama does not have an old copy. That basically is all the birthers have to go on. But different states say very different things on their birth certificates and people are saying it’s not valid if it’s not like mine, or because it doesn’t have the doctor’s signature or whatever. This is absurd or course, since it was good enough for the State Department to issue him a passport, but it does raise an issue. Will Arizona attempt to require all candidates to have a birth certificate that has exactly the same information on it as an Arizona birth certificate? That could be a problem since different states have different birth certificates at different times.

If the State Of Arizona succumbs to conspiracy theories maybe it’s time to ask Fox Mulder and Dana Scully to investigate. The truth is out there. Obama was born in outer space. His father is actually a Romulan.

For heaven’s sake, we got a financial crisis, we got an energy crisis, we got a resource crisis, we got an education crisis and we have the Taliban killing our soldiers. Isn’t it time to spend quality time on finding the best solutions instead of creating bills how we do the hunting for alien spaceships?

Snarp's avatar

@mattbrowne I don’t know about Romulan, but he does look a lot like Tuvok.

BoBo1946's avatar

don’t have time to discuss this one…everyone have a great weekend!

I think its a huge waste of tax payer money. I’m sure all of that is already investigated before they even go up for nomination.
They should pass a new law, where it is illegal to put idiots in local government.
I’m so glad I don’t live in Arizona.
Agree with Mattbrowne on this one. But I think he is wrong about his dad being Romulan. Probably Volcan.
