Could the threat of criminal action against BP dis-incentiveize them from stopping the leak?

If they think they will pay huge fines, get a lot of flack, potentially be taken over at a low price (given their current stock price) etc… why wouldn’t the heads of the company cut their losses? Or do we think they have enough sense of responsibility to stop the leak even know?
