How do "Breastaurants" get away with the discrepancy in dress codes for their female employees vs. the males?

Of course I haven’t done an exhaustive amount of personal investigation by going to a ton of these places. I’m going off my viewing of episodes of Undercover Boss.
The women’s outfits are the usual sexually titillating short shorts and skimpy tops with breasts pushed up alluringly.
The men were usually wearing regular slacks and a top bearing the logo of the establishment; no revealing short shorts or anything of the sort. (I do understand that managers, in general, usually dress differently from the rest of the staff. But not every male employee shown was a manager.)
How come they aren’t being sued right and left for the discriminatory dress codes toward women?
