How should I resolve this ebay problem I am having?

I recently bought an xbox 360 from ebay which included 3 games. Two of these games do not work as they appear to be scratched. Now I didn’t really want to play one of the scratched games, but the other I kinda did. The price of the bundle wasn’t really more expensive than just buying an xbox 360 alone.

So should I mention this to the seller, and ask for a £2 or so credit in order to repair the cd or should I just leave him neutral/positive feedback and ignore it (if its too much hassle)? The xbox 360 works fine btw (at least for the hour or so I played on it.. maybe I should test it some more).
