Who claimed the website Healthcare.gov was HIPAA compliant?

There is a big fire running around facebook about a video, starring Joe Barton (R-TX), ranting that the Healthcare.gov website is NOT HIPAA compliant.

Well, HIPAA applies to insurance and health care providers only. The website is neither an insurer nor a health care provider, so HIPAA doesn’t even apply!

My question is, did someone claim that the website was HIPAA compliant? If so, who?
