What if August's 2011 French Vogue's cover pictures were found in a person's hardrive?

If a person was suspected of distributing child porn, and someone found these pictures, (accidently or not) in their harddrive, what would happen? Should magazines/TV networks, et al not be treated the same way? Isn’t the act the same whether it is commited in the open or not?
