Could rape transform in to consensual sex? Will it be unpunishable?

Lets discuss this situation:
A woman was walking alone in dark alley and then suddenly a man grabbed her from behind and dragged her in to a secluded room. There, she was raped. The act is initiated forcefully. However, in the process of the rape the woman suddenly become cooperative, even goes as far as wanting more to be done to her. In the end, she was released by the man, the man that she has come to recognized.

A few days after the incident:
Both the perpetrator and the woman are now ended up in court room. She has reported this as a rape in police department and now she is here to sue the man that raped her. Long story short, the man claims that the woman “was satisfied with the sex, saying that she wants more, she even put her legs around my waist on her own”. Although embarassed, the woman counter with “Yes, I’ll have to admit that the sex was great, but he did it without my consent, I was cooperating because I believe there’s no way out of this situation, and I fear that if I fight back he could’ve killed me or worse, so I think it’s better for me to make the most out of the situation. I never agreed to have sex with him in the first place. He kidnapped me and raped me”. The man then replies with “But I didn’t even threaten her about killing or torturing her”. The woman then says “He hasn’t done that but I am sure he will eventually had I refused to cooperate with him so I just do what is expected of me to save my own life”.

And now is the time for the judge to make decision. How do you think it’ll ended up? Do you think such rape has become consensual sex that it becomes unpunishable by law?
