What is the maximum punishment for aggravated assault?

Can’t explain, just need to know what is going to happen.

It depends on your state and the level of damage/injury done as determined by the courts.

Rethink the assault if it hasn’t happened already. No one is worth going to jail for.

The sentence recommended by the DA’s office will also depend on the circumstances and the criminal history of the perpetrator. If it’s a first time crime, the sentence may (not WILL but MAY) be lighter than if it’s a career criminal that did it. That’s one example of the criteria that they will use when they make a sentencing recommendation and that the Judge will use when imposing a sentence.

This is for California, but is similar to sentences in other states.

Depending on the circumstances and the mood of the District Attorney, Aggravated Assault may be charged as misdemeanor or as a felony.

If a misdemeanor, you may be sentenced to a year in the County Jail. If charged as a Felony, you might go to prison for up to four years.

Good answers here, and worth listening to.

The only other factor to keep in mind is that in addition to the basic offsense, the particular facts can result in the assault being charged as 1st, 2nd, or 3rd degree.

So if you’re in fact thinking of punching someone out – Don’t. Thinking about it makes it predmeditated. Not good.
