I still havent recieved my 1099, cant i file without it?

There’s probably a 1099 substitute form that you can use if you can come up with a good approximation of your earnings. But you will have to explain how you came to that approximation.

I used a substitute W2 form last year because I lost my actual W2’s.

my income varied month to month so it would be hard to come up with an approximation.. thats what sux and my employer wont answer the phone or call me back! so im lost!

If you’ve made than a certain amount of interest you don’t need to claim it and you won’t receive a 1099.

Your employer is required to file 1099s by February 28th, which is a month later than the deadline to furnish W2s to full time employees. Any contract employee who earns more than $600 needs to be issued a 1099.

If you are being paid as a contract employee, you really need to set up a bookkeeping system and record your income, especially if it varies so much from month to month. Your are essentially a small business.

If you made over $600, Form 1099 must be mailed to you and postmarked no later than January 31. If you do not have one by Feb 15, you can request a substitute from the IRS.

If the payer is not answering the phone, they may have closed. You can file without it by estimating your income and filing Schedule C, this form will also allow you to deduct all your allowable employment expenses connected with this income.

If you do get a 1099 later, you can correct the amount if there is a difference using 1040X
