I bought a new phone and now im having trouble with it. what should i do?

I had the iphone for a couple of months and i loved it but about a month ago i went ahead and bought a blackberry. and ihave had a horrible experience with it. and didnt notice until a few days ago, but im lucky if my battery lasts even 4 hours, and i get no service anywhere. so i went to my carrier and spoke to them,and they diagnosed my phone and told me that it was defected, but they have a 30 day exchange fee, but they cudnt give me a new phone, because im 6 days past that, they said i could exchange it at another store, but no other store has the blackberry that i have. so from the store i called the costumer support and they said that they could exchange my phone for a refurbished phone. but no thanks, i mean 36 days ago, i paid 500 dllrs for a new phone, and im not going to accept a refurbished phone that can cost like 50 dllrs because the store sold me a bad phone. what is that???!.... and let me just add, i have no problem having a refurbished phone, its not like that, its the fact, that the store sold me something bad, which should mean, that if i paid full price for something i should get back what i paid for, if i paid for a refurbished then i shud get a refurbished phone back. it just makes no sense…. and they said thats the only thing that they could do to me.
any ideas on what i should do?

Tell them that for $500, they need to stand behind their service. Then let them know that you are happily contacting the better business bureau.

Why are they even charging you $500 to begin with? And why does no other store carry it?

You can also try contacting Motorola or whoever makes Blackberry and see if they will do anything for you. I would guess electronics should have minimum a 90 day warranty.

But you really should give that place a more difficult time before giving up. It just doesn’t sound right $500 for a Blackberry when Blackberry is trying to outdo Apple? Not to sure about that.

@mrrich724 thank you for answearing. the phone itself costs 450 dllrs, plus tax and everything so i ended up paying like 500 dllrs. the stores do carry it, but not the stores that give “exchanges” which i find ridicoulous. and yes atleast 90 days would be helpful, but i believe that any phone wether a day old or a year, if it is a phone defect they have to exchange it for you for a new phone, not a refurbished phone. im not giving up, ive called many times (im actually currently on the phone with them) ive gone to the store twice already and they cant do “anything” because that is their policy. I told them that im paying for a service im not getting, even to start an account (since im here on a student visa) i had to pay a 500 dllr down payment. so they have absolutley no right to tell me that they cant change a defected phone that they sold me. when i told them i would change they said go ahead thats why there is competition, and again, that leaves me nowhere, all i want is to have a phone that works. but every time i talk to them including right now, they say oh well im sorry, there is nothing else we can do, but yes they can, its not my fault, why should i have to suffer for their mistake.

@niks1112: How many days is the return policy? Why not just return the phone for a full refund and purchase another? If the return policy is less than 36 days and you were not happy with that time period why on earth would you sign the contract?

@malevolentbutticklish the return policy for the store is 30 days, there is a warranty for 1 year, but only to get back a refurbished phone. ive already had the contract for about a year, this had nothing to do with my phone service, this has to do with a bad phone that they sold me. i didnt sign anything when i bought this new phone

@niks1112: If you use the service that counts as consent to the terms. Sometimes there are multiple warranties. You may be able to apply under another warranty. If not then you were not cheated or robbed but instead you have buyer’s remorse. Maybe there is something you are not telling us. Were you offered a service contract but turned it down to save a few bucks?

if you paid on a credit card, your cc company may also insure it, or offer a program similar…

This has nothing to do with that, you are not understanding the point of my question, it is not as if ive been cheated or robbed, no, i paid 500 dllrs for a phone, and for a phone that does not work. why do i have to be getting an old phone when i paid full price for something.and if i were to be getting an old phone back, then i should be reimbursed the difference between the two phones. , and no there is nothing that i havent said, im not cheap and i pay up for everything, i wasnt offered shit and if that is all you can say then dont answear my question, because im here to see if people can give me ideas of what i can do to not get a refurbished phone, when i bought a brand new phone. so if you have no help to give me then dont waste my time.

@niks1112: From what you posted you paid $500 for a phone that doesn’t work with the agreement that if there was something wrong with the phone you would tell them within 30 days. Since you didn’t tell them in the 30 days it doesn’t matter if it was broken when they gave it to you. That was the length of time you had to inspect and test for proper operation. If you didn’t inform them of the problem in that time period your best bets aren’t very noble. You could lie and tell them you attempted to address this within the 30 days. You could cause a big enough stink that they did it against there policy… or you could accept the refurbished phone as you agreed to do in this event!

@niks1112 A refurbished phone will work the same way as a brand new one, in my expereince, they’re evn better than brand new ones like the one yougot in the first place. Refurbs are devices returned because there was an initial problem with it. They were returned to the manufacturer fort repair, addressing the initial flaws. Refurbs will carry the same remaining warranty as your new defective device. I say go ahead and take the refurb, use it as much as you can, put it through the ringer to really test it to the limits.

again, you are wasting both of our times, i told you to no longer respond to my questions, and there you go again…. giving no advice whatsoever. i know everything you said, trust me ive spent my time going to the stores and on the phone, do not act as a sales representative, when your not one, and i didnt ask you to repeat the policy for me.

if you think someone is offering no help whatsoever to your questions just flag them :)

but don’t continue telling them they aren’t helping b/c odds are they already know that and care more about their opinion than actually helping you… it’s fluther :/
