Can someone stop ashes being buried in a faamily plot?

a member of our family dosen’t want my dads ashes buried with my mums, can they stop it?

In the UK, you would need to check with the cemetery owner (this is frequently the local borough or city council) to see if anyone has been granted an “EROB” (Exclusive Right of Burial) on the plot. If such a right was purchased, then person who holds that right has the exclusive say on who’s buried in the plot.

The EROB is sold for a specified length of time, and may have been transfered by the original owner to an heir in his or her will.

You can file for a court injunction to temporarily stop it, but you will have a court date and have to show good cause (I don’t want it, is not cause) to the judge.

Be forewarned, if you do this and loose, the others can sue you for mental distress or a variety of other things.
