Would this be indecent exposure (see details)?

If a woman has had a double mastectomy, and chooses to go topless in her yard while gardening on a hot summer day can she be arrested for indecent exposure? Is the law about breasts or women in general? What about in the park playing frisbee with some friends (as men often do)? At the beach? Thoughts about this (including legal knowledge if you have it) please…

I know that since the decency laws were challenged in New York at least two years ago that police there won’t arrest women for being topless anywhere in the state unless there is some actual lewdness attached.

I do not think there should be laws against showing what God has given. It is not illegal for men, even if they have bigger breast than the women.

I wish they would arrest people for indignation. That way, anyone who complained about seeing someone else’s lady-nipples would be carted off and we could all get on with our breast-feeding and topless lawn mowing in peace.

As absurd as it is, I suspect that a woman’s nipples are the offending factor to these indignators. Breast tissue or lack thereof would make little difference. They hate lady-nipples and that’s that!

It completely depends on where you live. In various locales throughout Wisconsin, it is alright to be topless as long as you’re sunbathing. But, you could get cited for indecent exposure for other topless acts. DUMB as that is

I should have added that there was no reconstructive surgery, therefore no nipples (lady or otherwise). I kind of thought that was a given. Sorry.

How could the authorities prove it’s a female? She could draw nipples on with a sharpie, don a baseball cap and no makeup and some brown shorts and wa la! I guess.

A woman I knew had this issue. She got some flak for doing yard work topless. It was rather silly, actually, she was whippy thin, had a filled bra that she wore in public, just for form’s sake, but resented that she couldn’t be comfortable at the beach. It was 20 years ago, I was wondering how it would be now. (I lost touch with her a while ago, so I couldn’t ask directly.)

I think the whole idea is ridiculous – of women not being allowed to go topless, that is.

It’s legal for women to be topless in all public places in Ontario. Everywhere that men are, that is, so outdoors for the most part. It honestly hasn’t been a big deal, and I think that since it became legal, I’ve seen two topless women.
