If someone has a criminal record, will this fact be revealed when they cross the border into the USA?

Asked by mactonite (10points) January 27th, 2011

Let’s say someone has been convicted of a criminal offense. They travel to the USA. Can a border guard tell from their passport that they have been convicted?

No they shouldn’t be able to but if they are applying for a visa, their record would probably be a factor in whether they get it.

Entering the US is not the only potential problem. If you get in, you may be denied reentry into the country of origin when you try to return home.

Yes, my ex had a 20 year old DUI when we went to Mexico. We were checked at just a connecting flight in LA. We didn’t even ask to stay in your country! He had to explain in a small room with 2 security people. They did let him through. This was 2006.

@WestRiverrat Why would Canada deny us coming home?

Only from countries that keep records through computers. Canada, UK, and most of western Europe. But, as an example, you are a Mexican national and you have a conviction, more than likely if you are eligible for a visa and get it you are ok. It would help if you tell us wich country you are talking about.

@faye They wouldn’t if you are Canadian.

@faye You would have to ask the Canadian border patrol that.

There was a 60 minutes segment back in the 80s on a gentleman stuck in one of the NY airports because the US denied him entry and no other country would take him. At the time of the interview he had been living in the airport for 7 months.

Sorry, I just assumed the OP was Canadian.

@faye Ok if you come from Canada directly into the US and are a Canadian Citizen, if you are denied admittance into the US Canada will take you back. But if you are from say Brazil and try to come through the border from Manitoba into North Dakota and are denied entry. The Canadian border agents can also deny you entry into their country when you turn around and go back.

Sounds perfectly right to me @WestRiverrat. Send them back to where they came from.

@faye a DUI 20 years ago caused you that much trouble. That is rediculous. I would be pissed.

@Simcoe Do you know anyone who has gone through this site? Would it erase a 20 yr old DUI? @Mikewlf337 Canada takes DUI“s very seriously now.

Mikewlf337's avatar

@faye as bad as drinking and driving is. That is just rediculous. 20 years ago? People make mistakes. They should leave something like that which happened so long ago in the past. Pretty soon you won’t be able to fart without regretting it for the rest of your life.

Why would Canada deny us coming home?

If you are a Canadian citizen, Canada, by law, cannot deny you entry, even if you have committed murder!!
