How can I force an employer to give me a W2 for last year? I believe he was evading federal taxes.

I worked for an employer last year as a waitress.
I’ve tried several times to contact this person in pursuit of a W2 or at the very least a 1099. I had over 2500 in income before tips last year with this employer. I cannot get in touch with my employer and taxes are due soon. I believe this employer was evading irs federal taxes. I never received check stubs. He paid me in cash, and said he was taking taxes out of my money, so at the time I thought that he was doing everything legally. I’m not sure what to do. But I’m a single mom and need the income or I’ll receive no tax refund (which I desperately need) PLEASE HELP.

Will I get in trouble if I call and report that I think he may be doing things illegally? What can I do to still claim this job and get my taxes finished on time.

You won’t get in trouble if you report his tax evasion. In fact, if there is a cash recovery from him as a result of information that you provide, you may be entitled to a reward, known as a moiety.

But next time, come on. Don’t be dumb, okay? Even if you work for cash wages you should get a receipt that shows hours worked, the pay rate, and the various withholdings, all itemized and correct to the penny.

agreed. pretty mad at myself. was being niave thinking that he might have been a decent person. Although I did clock in in the computer system so there should at least be a record there when I report him. Also DHS will have a record of my reporting the job.Do you know anything about how I’d go about getting my wages reported by any chance? Thank you for your response.

I don’t know what DHS is, or what kind of records might be in the computer system that you used, but that’s not so important here. And don’t expect to get a “refund”, because there was never any withholding done on your account in the first place.

File a 1040 showing your full wages, and be prepared to pay taxes on them. But call the IRS first to tell them you don’t have a W2 or any pay stubs. They can advise you on how to proceed.

@nebula52088 There is a procedure and form if you’re missing the W-2. If you want I can look it up for you.

I worked once for an employer who did this. My father, who is a CPA, filed the form for me indicating that I was missing a W-2, and estimated the taxes that would have been deducted. I also provided the IRS with the employer’s personal address (the IRS used to call the work place looking for him so I know they were on his tail and would welcome my information). I got the refund from the IRS that was due me, and I don’t know what happend with the employer, as I no longer worked there anyway.

I helped a friend through this same situation many years ago. There is a process for you to go through. It will delay your filing as they have so many days to reply. Start the process and don’t have their mistake turn into one for you.
