Can I legally sell my cell phone?

I just renewed my provider contract and got a new model Blackberry. The thing is, my provider sold out to AT&T and they will be giving me a new compatible equivalent phone in 2 months.

This current phone will work with Verizon and other providers (just not AT&T’s network) and it is not “provider labeled”. It seems a waste to shove it in a drawer and I’m aware that I can donate it, though the current service said they don’t want it back, but I wonder if it’s legal to sell it to someone who uses a different network?

I know these things can be tricky sometimes. I paid for it. Do I own it?

Yes you do own it and yes you can sell it legally.

Yes, you can sell it. There are other options as well:

- your phone can be stored in your car (or other useful place) for an emergency; you can use an un-activated cell phone to call 911.

- you can recycle it at most cell phone stores.

- you can donate it to charity. Example: there’s an organization in my city where you can donate your old cell phone ..and it will go to someone who needs it (like a woman who is in an abusive relationship).

Thank you both. I know it seems obvious but I have run into not actually owning what I think I own when it comes to electronics.

My friend also mentioned cell phones for soldiers as an option.

Yes, you may sell it. Be sure to remove the sim card as it may contain some of your personal information.

just throw it on ebay. I just paid $70 for a phone to replace a lost one. Got a new sim card, unlocked it, voila! saved alot of $.
