Can someone legally do this?

Asked by frankielaguna (256points) October 22nd, 2009

I’ve received a number of documents with the following as the first line:

“By receipt of this document, you accept the following”

and then proceeds to list changes in rules and other items.

Can someone legally make you accept rules or changes in rules just by stating because I received the document?

No. You have to have the option to refuse, though they may then close your account, or whatever, if they choose.

If the initial contract or agreement allowed them to notify in this manner and you accepted that, then they can do it. All they need to do is prove that your have been notified – usually by a “signature required” mail or courier delivery. If you have not agreed to those terms, then no, it is meaningless.

I’d like to see a judge and jury let me off by saying ’‘by hearing my say this you accept that i am innocent’’.

send them an email back, telling them that by ’‘receipt of this document you accept to provide me with a steady wage and food for life’’.

In apartments in California, if we are on a month to month tenancy I can give out a “change of terms” with 30 days written notice. The logic is that if the person does not want to agree to the terms then they can always give 30 days notice and move.
The laws have changed in the last few years, and if I want to increase the rent and they have lived there more than a year I have to give them 60 days notice.

by reading my answer you agree to only wear green from now until you die.
