Can I give away a CD with music to my customers?

Asked by grrgold (91points) November 23rd, 2009

I was thinking of running a promotion for my customers, if i purchase some music tracks and record them on some CD’s can I give them away as a promotional item as long as I don’t charge anything for them?

Nope. That is still infringing on copyright laws and such. Basically you are giving away free music when they should be buying it themselves. Now if you make the music yourself then you can do it.

Got to go with @RedPowerLady.

You need to pay for every copy of the song you give away.

Or you could break the law and hope you don’t get caught. It would be very, very expensive to get caught.

Legally no, but how many customers do you have? If it’s less than 1,000 then chances are really slim that anything bad would happen.

There are some marketing companies that might provide you with a service, whereby they will burn some songs on CD and the royalties would be included in the fee.

Another route you might want to pursue is to contact ASCAP or BMI and see if a license from one of these organizations would allow you to distribute said CD’s.
