Is this really legal?

Asked by jessylee (90points) December 29th, 2010

I am suing a person who works at Petco for robbing me. I have a lot of animals, and have to buy food about once a week. Were I live Petco is the only place that sells one of the foods I feed my dogs. I have never said anything to her when I go in there or tried started anything. Yet I go in there today ask for my 10lg crickets and go to get my dog food. Then the manger I am friends with come up to me and says “just so you know you are not supposed to come in here with what’s going on with you and blank”. Is this really legal I am the victim and i have to drive 2 hours to get dog food and crickets. When there is a Petco on my way home from work 5min from my house?

It depends on what’s going on with your lawsuit. If you aren’t suppose to be going near her or her place of employment because of something in the lawsuit, then yes, it’s legal. If you have a lawyer, talk to them about it and see what’s going on. In the meantime, perhaps you can ask your friend to pick up the food for you.

It is entirely legal for a business to ban someone from their property. And if you have a no contact order in place, if she is somewhere first and you come into the building, you are the one at fault if you do not leave once you determine she is there.

Does this person have an Order of Protection against you or you against them?

No it is just a small clams case for 1500. it has nothing to do with Petco and there is nothing saying we can’t go near each other. She sent me an email asking to be friends and dropping the case. I said no I will not drop the case and now i can’t go buy dog food apparently and she can come in my work with no problem. i have no problem seeing her i just go stright in get my food and crickets and leave that is all.

@jessylee Perhaps she said something to her work about you suing her and asked them to not allow you to come in. As @WestRiverrat said, a business can ban someone from their property any time they want to. Perhaps you could ask your friend (the manager) specifically why you can’t come there anymore.

Welcome to Fluther.

If you want to start a pissing contest between you and the manager “who you are friends with”, then by all means start ‘er up. I’m sure you can find all kinds of ways to start that brouhaha.

But if I were you I’d ask the manager, since he’s your friend, how he can help you get done what you need to so that you can avoid going into the store and causing any trouble for him. He just doesn’t want to get in the middle of something and have it cost him business from other customers or any other legal problems. If you just call him from the parking lot, for example, and give him your order, I’ll bet he’d be very happy to have it taken to you by someone else, so that he could avoid having the two of you come in contact in the store.

A business owner has the right to decide who is allowed to shop there, except for specific discrimination laws.

You can probably order the dog food directly from the manufacturer and have it delivered directly to your door.

If there is not a problem going on, then tell the manager so, and ask where he heard about the supposed problem.

If there is a problem going on between you and blank, then attempt to fix the problem and then you can go back to buying pet food. In the meantime, take @YARNLADY ‘s advice and get your pet food delivered, or ask a friend who is not involved with the problem to buy pet food for you.

You feed your dogs crickets?

This sounds like BS to me, it doesn’t sound like he has any reason to ban you.

@XOIIO Answer the question, not just comment on it please. I really shouldn’t have to tell you that, considering that you have 107.1777777… times more lurve.

Anyway, so I don’t seem like a total hypocrite by posting an answer without having an answer in it, I will now add on to my previous post.

If you also bought meds from the store, use 1800-PET-MEDS. They deliver to your door.

I did answer the question. It doesn’t sound like he has any justification to ban herShe should ask him why he did it.

Also, lurve doesn’t really matter. Fluther is about the community, not how much lurve you have. Fluther wouldn;t change a whole lot without lurve.

Whoa…

lots of modded answers.

Well @jessylee definitly talk to the owner about it, and see whats going on. Let us know how it goes, and good luck.

The modded answers were mine and XOIIO. We were fighting about the importance of lurve and how it relates to the “noob to epic” scale.

Anywho, to answer the question: Yes, it’s legal.

That sounds totally legal.

The manager is more than likely concerned with something happening on the store’s premises, and wants to avoid any possibility of a flair up. And it doesn’t sound like you’ve been barred from the store for any reason.

I’m sure that there’s no way for you to get this person’s schedule, but I’m also certain that they don’t work there 24 hours a day. Try to make sure you’re not stopping in when the employee is there, and I’m fairly certain you’re going to be addressing the concerns of the manager.
