As far as I know it is in every state. But yes it is in New Jersey. I know because one of my neighbors was arrested for it.

Here’s the official page of all the penalties and fees:

i spoke to a couple of lawyers and they said it is not in NJ….I also googled it and I got mixed results….I will try and call DMV

I looked at tht link cat…. It doesn’t say anywhere that it is criminal

scamp's avatar

It’s against the law and punishable by jail time. How are you defining the word criminal?

would it show up on a criminal background check

I’d ask another lawyer. At the very least it would be on your driving record. It shows up on my neighbor’s record. I just gave him a quick call and he said he had trouble getting a job because it showed up on his background check. There is a possibility the lawyer you were talking to meant it could be expunged under certain circumstances.

thanks….I wanted to know I’d it shows up on background checks… I think but am not fully certain tht NJ is a state in which it is not considered criminal….I recieved one 4 yrs ago…. It has got me sweating now

You could always run a background check on yourself and see if it shows up. That way you would know for sure.

I did….I ran 3….but big companies I’m sure have better access…so I’m still super worried….a stupid youth mistake may come back to haunt me….

I wouldn’t worry too much if it was 4 years ago. people can learn and chnge a lot in that period of time. Good luck to you!

It depends on the situation surrounding the dui. In all states, a certain number of multiple offenses becomes a felony. Usually the first or second is a misdemeanor. There are also some other things that can make a dui a felony such as the offense described in this this article . So, it basically depends on circumstance.
