Mountain Mike's Pizza is offering $49K to anyone who can kick a field goal after being selected in a random drawing. Isn't this against the ADA?

Asked by Kraigmo (9055points) September 10th, 2023

The only way to win Mountain Mike’s contest is to first be selected in a random drawing, and then (at your expense) you have to fly to Levi stadium and kick a field goal during that NFL game’s half time.
This basically means very few people can win that $49,000.
Isn’t this contest a violation of the Americans with Disabilities Act?

Looking at the ADA, this is what is covered: “The ADA prohibits discrimination on the basis of disability in employment, State and local government, public accommodations, commercial facilities, transportation, and telecommunications. It also applies to the United States Congress.”

I don’t think that a contest by a private corporation is covered under any of those categories. I might be mistaken, but I don’t believe any of the categories would apply.

No. We are not all athletic enough, rich enough, or strong enough to attempt to kick that field goal. Perfectly normal healthy people can’t kick a field goal. Them’s the breaks.

Nope. Everyone has the same chance and will end up missing it.
The restrictions are also tight enough to minimize the chance of kicking a 35 yard FG.

Current or former high school football, soccer, and rugby players and coaches who have played or coached at that level anywhere in the world within the past five (5) years.

Contestants shall not be permitted any practice, warm-up, or qualifying kicks, at any time after his/her notification of participation the promotion until the actual prize (kick)s.

Never heard of Mountain Mike’s – is that a western chain?

@Forever_Free Absolutely. In other words, it’s for publicity only and they have no intention of giving away any money.

How can MM stop someone from practicing? They’re dreamin’. I’d stop giving MM my business purely out of spite.

The entry rules are silent on any requirement from eating Mountain Mike’s pizza, but that would be disqualifying because it is lousy pizza.

You have to use their app to apply. what a waste of phone space.

@zenvelo The rules do say no purchase required.

@smudges agreed. What a scam!

They covered themselves for the disabled. You must enter through their app & all eligible participants must be members of the Mountain Mike’s mobile app program (Mountain Rewards®) and will need to enter for a chance to be randomly selected as the official field-goal kick Sweepstakes entrant. So ONLY people who have taken the time to enter will be entered in the random drawing. As someone who is disabled, I would NOT be entering & probably wouldn’t have their app so I wouldn’t even know about it!!!

As far as covering the expense of the trip…The Sweepstakes is open to legal residents of California who are 18 years of age or older with a primary residence located north of Kern, San Bernardino and San Luis Obispo Counties. I haven’t looked at a map, but am willing to assume this area is within a reasonable driving distance. Once again nobody would register if they couldn’t get there.

This is a sweepstakes for a die-hard fan & those of us with disabilities wouldn’t be interested in their offer & wouldn’t register. Since this occurred yesterday, I did a quick search to see if there was a winner & nothing came up in my search.

@LayMarissa Those counties have locations that may be a four or five hour drive from Santa Clara where the stadium is. But there are towns at the northern end of California that are a five to six hour drive. Not an easy drive.

At an age when I was in high school and college, I used to practice field goals. 40 yards is very doable.
