I bought my iPhone 3G 13 days ago can I upgrade to the iPhone 3GS?

I believe the time period is 30 days, I will have had mine 25 days when the new iPhone comes out. Can I upgrade for free?

You can return it to the Apple Store if you bought it there for a 10% restocking fee, not sure if they have any other options available right now. You should call them or AT&T.
